NOTICE OF PRIVACY PRACTICES


IMPORTANT INFORMATION ABOUT YOUR PRIVACY
This notice describes how medical, mental health, and drug and alcohol–related information about you may be used and shared, and how you can get access to this information. Please review it carefully.

HOW YOUR HEALTH INFORMATION IS PROTECTED

Information about your health care, including payment for health care, is protected by several laws, including:

  • The Confidentiality Law, 42 U.S.C. § 290dd-2

  • 42 C.F.R. Part 2

  • The Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), 42 U.S.C. § 1320d et seq.

  • 45 C.F.R. Parts 160 & 164

  • The Michigan Mental Health Code

If you are receiving substance use treatment, Hegira Health, Inc. (HHI) may not disclose to anyone outside HHI that you attend the program. HHI may not share any information that identifies you as a person with a substance use disorder, or share any other protected information, except as allowed by federal law.

HOW HHI MAY USE OR SHARE YOUR INFORMATION WITHOUT WRITTEN PERMISSION

In accordance with applicable law, HHI may use or share your information without your written permission in the following situations:

  1. To comply with applicable law, including responding to lawsuits, subpoenas, or court orders

  2. For HHI staff to provide diagnosis, treatment, and referrals

  3. To operate our organization, improve care, and contact you as allowed by law

  4. To bill you or your insurance company or funding source and receive payment for services

  5. In connection with agreements with other organizations involved in your care

  6. For research, audit, or evaluation purposes

  7. To report the threat of, or an actual crime committed by you on HHI premises or against HHI personnel

  8. For medical personnel during a medical emergency or for tissue/organ donation requests

  9. To report suspected child or adult abuse or neglect

  10. As allowed by subpoena, court order, administrative order, or federal requirements

  11. As allowed by federal, state, or local law, including public health, national security, threats of harm, medical examiner, or funeral director purposes

  12. When the information does not identify you as a person receiving substance use or mental health treatment

  13. To prevent or reduce a serious threat to anyone’s health or safety


Before HHI may use or share your health information in any way not listed above, we must obtain your written permission. You may cancel your permission at any time by submitting a written request.

YOUR RIGHTS

You have the right to:

  • Request limits on how your health information is used and shared. HHI is not required to agree to all requests and may deny a request if it affects your care. However, HHI will not share your information with your health plan or funding source if you personally pay for services in full, as allowed by law.

  • Receive health-related information through secure communication methods, unless you request otherwise.

  • Not be contacted about HHI fundraising or marketing unless you give permission.

  • Know that HHI will not sell your health information.

  • Be notified of any breach of your unsecured protected health information, as required by law.

  • Request that we communicate with you in a specific way or location. Reasonable requests will be honored without requiring an explanation.

  • Inspect and receive a copy of your health information maintained by HHI, except in limited circumstances such as legal proceedings.

  • Request that information be added to your health record, with some exceptions.

  • Request and receive an accounting of disclosures of your health information made by HHI (excluding treatment, payment, and operations) for the six years prior to your request. One accounting per year is provided at no cost; additional requests may incur a reasonable fee.

  • Receive a paper copy of this notice.

  • Have a personal representative act on your behalf regarding your health information and privacy rights.

  • File a complaint with HHI or the U.S. Department of Health and Human Services if you believe your privacy rights have been violated under HIPAA, or with the U.S. Attorney General for substance use confidentiality violations. Filing a complaint will not affect your services.

  • Request corrections to your medical record if you believe information is incorrect or incomplete. HHI may deny the request but will provide a written explanation within 60 days.


HHI’S DUTIES

HHI is required by law to:

  • Maintain the privacy of your health information

  • Provide you with this notice

  • Follow the terms of this notice

HHI reserves the right to change this notice and apply the revised terms to all protected health information it maintains. Updated notices will be available through clinic staff and posted on the HHI website.
Your health information may include written, electronic, or verbal records created or received by HHI, including information about your medical history, diagnoses, test results, treatment, prescriptions, billing, and related health care services.
